COVID-19 Terms and Conditions

COVID-19 ENTRY TO PREMISES TERMS AND CONDITIONS

  1. I hereby acknowledge that these premises are operated by the Cape Peninsula Ice Skating Club trading as The Ice Station (“The Ice Station”).
  2. By completing this COVID-19 screening questionnaire to enter The Ice Station, I confirm to the best of my knowledge that
    1. I am not infected with the COVID-19 virus,
    2. I have not been in contact with any person who has been infected, and
    3. I have not traveled to any destination that is considered a high infection rate area.
  3. I also agree and give express consent to The Ice Station and its agent(s) to obtain, process and further process my Protected Personal Information for any lawful purposes relating to its COVID-19 preventative measures implemented at The Ice Station. I understand that my Protected Personal Information includes at least, my full names and surname, identification number, address, and telephone number and if applicable at least, my child/children’s names and surname and date of birth/s. The obtaining, processing and further processing concerned includes at a minimum for The Ice Station to:
    1. Record my Protected Personal Information;
    2. Meet any lawful obligation imposed on it;
    3. Furnish my Protected Personal Information to any authority and entity which is part of The Ice Station for purposes of giving effect to the promotion of COVID-19 restrictions and preventative measures;
    4. Performing any analyses to identify potential risks, persons and trends in relation to COVID-19.
  4. Furthermore, I agree and consent to The Ice Station retaining my Protected Personal Information for such periods as deemed necessary by The Ice Station for its legitimate business purposes and record keeping protocols as required by law.
  5. I accept that The Ice Station takes reasonable steps to safeguard Protected Personal Information in its possession.
  6. I hereby indemnify and hold harmless The Ice Station, its employees and agents against any liability, damages and/or legal action whatsoever and howsoever arising, including negligence on the part of The Ice Station, its employees or agents, and The Ice Station shall not accept liability for any damages or any type of loss suffered by me.
  7. All persons entering and /or utilising The Ice Station and/or any facilities, do so entirely at their own risk and shall have no claim for personal injury or damages of any nature whatsoever against the owners of the premises, or the Cape Peninsula Ice Skating Club, or its founders, management, committee or staff, regardless that any such claim may have arisen as a result of the negligence or gross negligence of the said owners, the Cape Peninsula Ice Skating Club, its founders, management, committee or staff.
  8. The Ice Station reserves the right to refuse me access to The Ice Station should I present any signs or symptoms in relation to the COVID-19 virus, or in the event that I am not fulfilling the purpose for which I entered these premises, or for my undesirable conduct within these premises for purposes of promoting COVID-19 preventative measures.
  9. In the event that The Ice Station makes any indulgence or deviation of these terms and conditions in favour of me, then such indulgence or deviation shall not be misinterpreted to be a breach or waiver of these terms and conditions or any rights of The Ice Station.
  10. The above clauses are sever-able from each other. In the event that any clause or part thereof is unenforceable in law, then that clause or part thereof shall be severed from these terms and conditions, and the remaining clauses and parts thereof shall remain in force.
